These Terms of Service (“Terms”) govern your access to and use of JTM Cast, including the JTM Cast website, cloud edition, local install edition, related software, support services, and associated features (collectively, the “Service”).
The Service is developed and operated by JTM LLC (“JTM,” “we,” “us,” or “our”). By creating an account, subscribing to a paid plan, installing or using JTM Cast, or otherwise accessing the Service, you agree to these Terms.
1. Scope
These Terms apply to all users of JTM Cast, including churches, ministries, organizations, administrators, staff members, volunteers, and other authorized users.
If you use JTM Cast on behalf of a church, ministry, company, or other organization, you represent that you have authority to accept these Terms on behalf of that organization.
2. The Service
JTM Cast is a worship presentation and projection service designed to help churches and ministries prepare, manage, display, and, where supported, broadcast worship content.
Depending on the edition and plan you use, features may include Scripture display, hymn and lyric presentation, media projection, service program management, multiple output windows, synchronization across authorized devices, importing Bible translations, and streaming or broadcast-related functions.
JTM Cast may be offered as a cloud-based service, a local install edition, or both. Features and technical requirements may differ between editions.
3. Accounts
Some features require an account. You agree to provide accurate and current information when creating and maintaining your account.
An organization may have multiple authorized users or staff members, subject to the limits of its plan. Organization administrators are responsible for managing access and permissions within their organization.
You must not create accounts using false identities, misleading information, or information that you are not authorized to use.
4. Account Security
You are responsible for maintaining the confidentiality and security of your account credentials and for activities carried out through your account.
You must notify us promptly if you become aware of unauthorized access to your account or any other security incident involving JTM Cast.
You are also responsible for maintaining appropriate security on computers, mobile devices, networks, and other equipment used to access the Service.
5. Plans, Fees, and Renewals
JTM Cast may offer free and paid plans. Available features, storage, devices, outputs, staff limits, and other plan conditions are described on the official JTM Cast website or within the Service.
Paid plans are billed in advance according to the billing period selected at the time of purchase.
Unless otherwise stated at the time of purchase, recurring subscriptions may renew automatically until cancelled.
We may change plan features, limits, or pricing from time to time. Where required by applicable law or where a change materially affects an existing paid subscription, we will provide appropriate notice.
6. Cancellation and Refunds
You may cancel a recurring subscription using the cancellation method made available through the Service or by contacting us.
Unless otherwise stated, cancellation stops future renewals and the paid plan remains available until the end of the current paid billing period.
Fees already paid are generally non-refundable except where a refund is required by applicable law, expressly provided by us, or necessary to correct an error such as an unintended duplicate charge.
7. User Content
“User Content” means content that you or your organization enters, uploads, imports, stores, synchronizes, displays, or otherwise uses through JTM Cast.
User Content may include, for example:
- Orders of service and presentation programs
- Hymn lyrics and song information
- Bible translation data
- Slides and presentation files
- Images, video, audio, and other media
- Church or organization settings
- Other material uploaded or created through the Service
You retain ownership of User Content that you or your organization owns.
You grant JTM a limited right to host, copy, process, transmit, synchronize, display, back up, and otherwise handle User Content only as reasonably necessary to provide, secure, maintain, and support the Service.
8. Copyright and Other Rights
You are responsible for ensuring that you have all rights, permissions, licenses, and other authority required to upload, import, display, stream, broadcast, copy, or otherwise use content through JTM Cast.
This responsibility includes, where applicable, Bible translations, hymn lyrics, music, images, video, presentation materials, livestream content, and other copyrighted works.
The availability of an import, display, projection, or streaming feature in JTM Cast does not itself grant you permission to use third-party content.
9. Personal Information of Others
If you enter or upload personal information concerning another person, you are responsible for ensuring that you have a lawful basis and any permission required to collect and use that information.
Organizations using JTM Cast are responsible for complying with applicable privacy and data protection laws in relation to information they place in the Service.
You should not upload unnecessary sensitive personal information.
10. Acceptable Use
You must not use JTM Cast:
- In violation of applicable law or regulation
- To infringe copyright, trademark, privacy, or other rights
- To gain unauthorized access to systems, accounts, or data
- To interfere with or disrupt the operation of the Service
- To introduce malware, malicious code, or harmful material
- To circumvent access controls, usage limits, or security measures
- To impersonate another person or organization without authorization
- To use the Service in a fraudulent or deceptive manner
You must also not attempt to probe, attack, overload, reverse engineer, or misuse the Service except to the extent that such restriction is prohibited by applicable law.
11. Projected and Broadcast Content
JTM Cast is designed to assist users in presenting content, but the user remains responsible for determining what is projected, displayed, recorded, streamed, or broadcast.
Before making content visible to a congregation, audience, livestream, or recording, users should confirm that the intended content and output settings are correct.
JTM is not responsible for content that a user intentionally or accidentally chooses to display or broadcast through the Service.
12. Third-Party Services
JTM Cast may integrate with, link to, or be used together with third-party products and services, including payment processors, video platforms, browsers, operating systems, hardware devices, and other external services.
Third-party services are governed by their own terms, policies, and technical requirements.
We are not responsible for the availability, operation, policies, security, or content of third-party services.
13. Changes to the Service
We may add, modify, improve, replace, or discontinue features of JTM Cast as the Service develops.
We may also make changes where reasonably necessary for security, legal compliance, technical compatibility, performance, or service operation.
We will make reasonable efforts to avoid unnecessary disruption to users, particularly where a change materially affects a paid service.
14. Maintenance and Availability
We aim to provide a reliable Service, but uninterrupted or error-free availability is not guaranteed.
JTM Cast may temporarily become unavailable because of maintenance, updates, network conditions, infrastructure failures, third-party services, security incidents, emergencies, or circumstances beyond our reasonable control.
Users of the local install edition are responsible for maintaining the computer, network, storage, backups, operating system, and other local infrastructure required to operate that edition.
15. Suspension and Termination
We may suspend or restrict access to the Service where reasonably necessary, including where:
- These Terms are materially violated
- Fees remain unpaid when due
- Use of the Service creates a security or operational risk
- Fraudulent, abusive, or unlawful activity is suspected
- Suspension is required by law or a lawful authority
Where appropriate, we will make reasonable efforts to give notice and an opportunity to resolve the issue before permanent termination.
You may stop using JTM Cast at any time and may terminate your account in accordance with the account and subscription procedures provided by the Service.
16. Data After Termination
When an account or subscription ends, access to some cloud-stored data may end or become limited.
You are responsible for exporting or otherwise retaining any data you need before deleting an account or before access to the relevant data ends.
We may retain certain information for a limited period for backup, security, legal, accounting, fraud-prevention, or dispute-resolution purposes.
Data stored only in the local install edition remains under the control of the user or organization operating the relevant computer, subject to the way that edition stores its data.
17. JTM Intellectual Property
JTM Cast, including its software, source code, design, interface, branding, logos, documentation, and other materials provided by JTM, is owned by or licensed to JTM and is protected by applicable intellectual property laws.
These Terms do not transfer ownership of JTM Cast or JTM intellectual property to you.
Subject to these Terms and the applicable plan, JTM grants you a limited, non-exclusive, non-transferable right to use JTM Cast for its intended purpose.
18. Feedback
If you provide suggestions, ideas, comments, bug reports, or other feedback concerning JTM Cast, you permit us to use that feedback to develop, improve, and operate the Service without an obligation to compensate you.
This does not transfer ownership of your unrelated User Content to JTM.
19. Disclaimer of Warranties
To the maximum extent permitted by applicable law, JTM Cast is provided on an “as is” and “as available” basis.
We do not guarantee that the Service will always be uninterrupted, error-free, compatible with every device or third-party service, or suitable for every particular purpose.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded or limited.
20. Limitation of Liability
To the maximum extent permitted by applicable law, JTM will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, business opportunities, goodwill, or data arising from or related to the use of JTM Cast.
To the maximum extent permitted by applicable law, JTM’s aggregate liability arising out of or relating to a paid Service will not exceed the amount paid by the relevant customer to JTM for that Service during the twelve months immediately preceding the event giving rise to the claim.
For use of a free Service, JTM’s liability will be limited to the extent permitted by applicable law.
These limitations do not apply where liability cannot lawfully be excluded or limited.
21. User Responsibility
You are responsible for how you configure and operate JTM Cast, including selecting presentation content, verifying output, maintaining appropriate backups, managing authorized users, and complying with laws and third-party rights applicable to your use.
You are also responsible for determining whether the Service is appropriate for your organization’s operational requirements.
22. Changes to These Terms
We may update these Terms when the Service, applicable law, pricing structure, or our business practices change.
The revised Terms will be published on the JTM Cast website with an updated effective date.
Where required by law or where changes materially affect existing users, we may provide additional notice before the changes take effect.
Continued use of the Service after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
23. Governing Law
These Terms are governed by and interpreted in accordance with the laws of Japan, without regard to conflict-of-law principles.
24. Disputes and Jurisdiction
If a dispute arises concerning JTM Cast or these Terms, you and JTM should first attempt in good faith to resolve the matter through discussion.
If the dispute cannot be resolved through discussion, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance, except where applicable law requires otherwise.
25. Language
These Terms may be provided in Japanese, English, and other languages for convenience.
If there is any inconsistency or conflict between the Japanese version and a translation, the Japanese version shall prevail, except where applicable law requires otherwise.
